What Is Earnest Money, and How Does It Work in Tennessee?
“You are never too old to set another goal or to dream a new dream.” ~ C.S. Lewis
Buying a home is exciting, but it also comes with unfamiliar terms. One of the first you may hear after making an offer is earnest money. What exactly is it, where does it go, and can you get it back?
If you're buying a home in Murfreesboro, Rutherford County, or anywhere in Middle Tennessee, here's what you need to know.
What Is Earnest Money?
Earnest money is a deposit a buyer makes to demonstrate they're serious about purchasing a property.
Think of it as a good-faith deposit that accompanies your commitment to buying the home.
It's important to understand that earnest money is not an additional fee. When the transaction closes, it's typically credited toward your purchase price, down payment, or closing costs.
How Much Earnest Money Do You Need?
There's no universal amount required for every Tennessee home purchase.
The amount is negotiated between the buyer and seller and may depend on the home's price, market conditions, and the terms of the offer.
For example, a buyer purchasing a $350,000 home might offer $3,500 in earnest money. That's simply an illustration, not a required amount.
A larger deposit may strengthen an offer, but it also means more money could be at risk if the buyer fails to meet their contractual obligations.
Where Does the Money Go?
Earnest money generally isn't handed directly to the seller.
Instead, it's delivered to the designated holder identified in the Purchase and Sale Agreement. This may be a title company or real estate brokerage.
The contract establishes how much is due, who will hold it, and when it must be delivered.
Pay attention to that deadline! Failing to deliver earnest money as agreed can create serious contractual problems.
Can You Get Your Earnest Money Back?
This is probably the question I hear most often!
The answer is: It depends on the terms of your contract and why the transaction doesn't close.
Certain contractual contingencies may allow a buyer to terminate the agreement and receive their earnest money back.
Depending on the agreement, these might involve:
Home inspections: Issues discovered during the inspection process.
Financing: The buyer being unable to obtain financing under the contract's terms.
Appraisal: A property appraising below the agreed purchase price, when applicable contract protections provide a remedy.
However, these protections aren't automatic. They depend on the actual contract language, required notices, and deadlines.
What Happens If There's a Disagreement?
Sometimes a buyer and seller disagree about who should receive the earnest money after a contract ends.
In Tennessee, the designated holder must follow applicable rules and the contract when disbursing those funds. Depending on the circumstances, resolving the disagreement may require a written agreement, interpretation of the contract, or court involvement.
That's why understanding your contract before signing is so important.
